Case Consultation

Case documents will be reviewed in order to gain familiarity with case issues. We will further work with counsel in preparing for trial by preparing recommendations on case themes and trial strategy based on learnings from the large survey research and/or focus groups (async or simulator). We will also work with counsel to develop best approaches to voir dire and trial presentations. Further, as trial approaches and the case is assigned to a courthouse and judge, we will provide an overview of our experience in the venue as well as key takeaways from prior experience in front of the judge (if applicable).

In-Court Jury Selection

Once jury selection begins, we will use a combination of information garnered from juror questionnaires as well as jurors’ responses during voir dire questioning to suggest follow-up voir dire questioning, make recommendations for cause challenges, and identify priority strikes.

Juror Questionnaire Development

We will develop a juror questionnaire based on predictive indicators from the large survey research, keeping in mind the parameters set by the court. This will help us identify jurors to strike for cause during voir dire.

Voir Dire Preparation

Prior to jury selection, we will draft or assist with drafting voir dire questioning designed to elicit experiences and attitudes from jurors that will help identify priority strikes. This draft will also include effective follow-up questioning and strategies to overcome security-related challenges.

Witness Preparation

Witness preparation is led by our team of expert behavioral scientists, ensuring witnesses are fully equipped to deliver clear, credible, and compelling testimony. We start with an in-depth interview to tailor our approach to each witness's needs, followed by an educational briefing on the legal process and the witness's role in the broader trial strategy. We enhance communication skills, focusing on clarity of speech and effective non-verbal cues. Through mock trials and role-playing, witnesses are exposed to the courtroom's pressures, receiving real-time feedback to refine their testimony. Psychological support is provided to build confidence and reduce anxiety, incorporating stress management exercises and confidence-building activities. Continuous feedback helps fine-tune narrative delivery and ensure consistency with the overarching case strategy. On the day of the testimony, our team offers on-site support for last-minute reviews and reassurance, ensuring witnesses are prepared and aligned with trial goals, thus enhancing their effectiveness in contributing to the trial’s success.
